Best Practice:
When the current child support amount in the child support order and the amount on the guidelines form do not match, the amount in the body of the order controls.
However, if there are elements of the monthly amount, such as daycare and cash medical, in the guidelines form but not in the body of the order, it is within the discretion of the CSS Attorney to instead use the guidelines form amount.
Examples:
If the amounts of daycare and/or cash medical in the guidelines form do not match the body of the order, the CSS Attorney shall take legal action to have the Court correct the inaccuracies, such as a Nunc Pro Tunc Order.
If daycare and cash medical are not addressed in the body of the order, but a guidelines form is attached with these elements and signed by the Court, then the child support guidelines amount shall control.
