Reinstatement of Cash Medical

Legal Authority: OAC 340:25-5-168

When a child support order contains a cash medical provision and information is received that the child(ren) are no longer covered on insurance the case must be reviewed to see if cash medical needs to be reinstated.

The case should be reviewed to see if modification is needed. A modification may be needed if the child support ordered included a credit for the insurance premium costs or if there has been another material change in circumstances in addition to the lapse in insurance.

If it is determined that no modification needs to be done cash medical will be reinstated using the expedited process.

To reinstate cash medical follow these steps.

Send the Notice of Proposed Reinstatement of Cash Medical Support (CM10 for the NCP and CM11 for the CP).

The parties have 10 calendar days to object to the reinstatement of cash medical support.

  • If neither party objects the Notice of Reinstatement of Cash Medical Support (CM13) will be sent, and cash medical will be reinstated on the first day of the second month following the date the reinstatement notice is printed. For example, the proposed reinstatement notice is printed on September14 the reinstatement date for the cash medical is November 1.
    • The obligation will be updated to add the cash medical support amount.
    • An amended Income Withholding Order will be sent to the employer.
  • If either party objects the district office will conduct a desk review within 10 calendar days of receipt of the objection. The objection must be in writing.
    • The office will review the information provided and determine if reinstatement of cash medical should be done.
    • The parties will be sent the Notice of Review Decision (CM12) after the desk review is completed to notify the parties of the decision.
    • The parties then have 15 calendar days from the date of the review decision to request a hearing.
      • If no hearing is requested the Notice of Reinstatement of Cash Medical Support will be sent to the parties and the cash medical support will be reinstated the first day of the second month following the date of the notice of reinstatement is printed.
        • The obligation will be updated to add the cash medical support amount.
        • An amended Income Withholding Order will be sent to the employer.
      • If a hearing is requested a hearing will be conducted and the Order Regarding Reinstatement of Cash Medical Support (CM14) will be done.
        • If the court finds that cash medical should not be reinstated there is no further action to be taken.
        • If the court finds that the cash medical should be reinstated the cash medical will be effective the first day of the month following the entry of the order.
          • The obligation will be updated to add the cash medical support amount.
