A chapter 13 case is filed by the debtor and is available to any individual with regular income and has debt within certain limits. Child Support is a priority debt.

The basic premise of Chapter 7 is the debtor trades all non-exempt property and a full disclosure of financial affairs for a discharge of personal liability on their debt.  Not all personal liability is discharged; a child support obligation is a non-dischargeable debt.

Bankruptcy is the legal action to eliminate debt and to get a fresh start. Child Support obligations cannot be discharged or modified in Bankruptcy. There are five types of bankruptcy.
