Closing Child Only Medical Cases Overview

Legal Authority(ies):

OAC 340:25-5-123 & ITS
45 CFR ยง303.11
SB 2194

As a result of Senate Bill 2194, Child Support Services revised its policy on closing child only medical cases on July 1, 2009. The change allows for case closure of child-only medical cases when either the custodial parent cannot be located, or fails to cooperate and is essential for the next step in providing child support services.

OAC 340:25-5-123 Case Closure System

(d) A child support case may be closed when the custodial person is receiving non-TANF SoonerCare (Medicaid) benefits for a child(ren) only when the custodial person:

(1) cannot be located under Section 303.3 of Title 45 of CFR (use OSIS Closure Code 16); or

(2) fails to cooperate and an action by the custodial person is essential for the next step in providing child support services under Section 303.11(b)(16) of Title 45 of CFR (use OSIS Closure Code 17).

Please see Instructions to Staff 340:25-5-123 (11) for examples of appropriate and not appropriate non-cooperation in a child-only SoonerCare (Medicaid) case.

Please note: You cannot close a child only medical case based only on a CP request, but you may be able to put the case into MEO status. Otherwise, the case must remain open for full services.
