Income Hierarchy: Overview

Legal Authority

When using the child support computation form, use the best evidence available to determine a parent’s monthly gross income. This includes:

  • written earning records,
  • past job history, and
  • earning ability based on education and training.

The goal is to use this evidence to set child support orders that are fair and equitable. Use actual income in the child support computation when that information is available.

It may be necessary to impute income when the information shows a parent is voluntarily unemployed or underemployed. Impute an amount based on the parent’s work history, education, training, and ability to work.

Note: Per OAC 340:25-5-124.4 ITS 2: An NCP is more likely to comply with an order that is no more than 20% of their gross income.
