Legal Authorities:
When the non-custodial parent (NCP) is ordered to pay Cash Medical until health care coverage is available, and the NCP acquires health care coverage, the parties must notify CSS that the child(ren) are now covered, and the cash medical termination process will be started.
When proof of coverage is received, it must be updated on the POLA screens. If the information is received in the local office forward the documents to the Employer Service Center (ESC) to be updated.
The Notice of Proposed Termination of Cash Medical Support (CM01 for the NCP and CM02 for the CP) will automatically generate if the Policy Verification on the POLA screen is Y (insurance verified), and the policyholder relationship is coded AP (NPC), AS (NCP Spouse) or AG (NCP Parent). If the policyholder is coded as anyone else the system will not automatically generate the documents. ESC will send a FYI to the office in these instances so that the cash medical termination process can be started manually.
Those cases where the analyzer determines that cash medical should be terminated will populate on the TRMLS screen. The system will automatically generate the Notice of Proposed Termination of Cash Medical documents to both the CP and the NCP. For more information see the CSQuest article The TRMLS Screen.
After the Notice of Proposed Termination of Cash Medical Support is sent:
The parties have 10 calendar days to object to the termination of cash medical support.
- If neither party objects the Notice of Termination of Cash Medical Support (CM07/CM07A) is sent 15 calendar days after the Notice of Proposed Termination of Cash Medical Support was sent. The cash medical support will be terminated the first day of the month following the date the notice of termination was sent.
- The obligation will be updated to remove the cash medical support amount.
- An amended Income Withholding Order will be sent to the employer.
- If either party objects to the termination of the cash medical support a review will be conducted within 10 calendar days of receipt of the objection.
- The Notice of Administrative Review Decision (CM06) will be sent to both parties informing them of the review decision. The parties have 15 calendar days from the date of the review decision to request a hearing if they do not agree with the decision.
- If neither party requests a hearing the Notice of Termination of Cash Medical Support is sent. The cash medical support will be terminated on the first day of the second month following the date of the Notice of Proposed Termination of Cash Medical Support. For example, the notice of termination is issued on September 14 the termination date for cash medical support is November 1.
- If a hearing is requested a hearing will be conducted and the Order Regarding Termination of Cash Medical Support will be done.
- If the court finds that the cash medical support should not be terminated there is no further action taken.
- If the court finds that the cash medical support should be terminated it will be terminated effective the date specified in the order.
- The obligation will be updated to remove the cash medical support amount.
- An amended Income Withholding Order will be sent to the employer.
- The Notice of Administrative Review Decision (CM06) will be sent to both parties informing them of the review decision. The parties have 15 calendar days from the date of the review decision to request a hearing if they do not agree with the decision.
