The Emancipation Letters EM01, EM02, EM03 and EM04 will automatically generate if the following criteria is met.
The document generates if all of the following are true:
- Case is full service (CSCU type service = F)
- Case is open for current support (CSCU IV-D status is 02, 10)
- Child is active in the case
- CHU delete indicator is blank
- CHU date removed is zero or a future date
- Child graduation date has not been verified by CSED (CHU verify not V)
- Child is not in DHS custody (CHU custody indicator not D)
- Child not currently eligible for foster care benefits (CHU current case type is not F E H or R)
- Child has a valid birth date on CHU
- Child will be 18 years old within 90 days
OR
Child is over 18 and has a graduation date and will be 20 within 90 days or the graduation date is within 90 days, whichever occurs first.
- No CSEM01 thru CSEM04 has been previously sent for the child
- Based on CN081DBD document variables
- DOCL action code must be G or S or P to be considered sent
And one of the following is true:
- The child is included in an active enforceable obligation:
- Order is verified (OBLU page 1 verified date > zero)
- Order is active (OBLU page 1 order status is A or C)
- Order has been signed by a judge (OBLU page 1 date signed not blank)
- Order has not been terminated (OBLU terminate date is blank)
- If interstate obligation, the referral must be active (REFU status not = T)
- The child is included in the order:
- OBLU page 2 included indicator = Y
- OBLU page 2 effective date is not a future date
- OBLU page 2 from date is not a future date
- OBLU page 2 end date is not in the past
- Child does not have paternity established (CHU legal status is M)
Then the child is eligible for a 90-day notice:
- If the child is included in an obligation, the appropriate EM01 and/or EM02 is/are generated.
- If the child is not included in an order and does not have paternity established, the appropriate EM03 and/or EM04 is/are generated.
Interstate cases
If there is an incoming interstate referral:
- the other state have the controlling order on OBLU, and
- if the other state uses emancipation ages different than Oklahoma it must be set up on EMANU, and
- There can only be N or A balances on the case.
Otherwise you’ll get the instate document.
