States Emancipation Ages

The age of emancipation will always follow the rules of the initial order. For example, If the original order was done in New York and the order was later modified by Oklahoma the age of emancipation would remain 21.

In most states, child support ends when the child turns 18 or up to age 19 if still in high school. However, not all states follow this rule. The emancipation age can vary from state to state. Below is a chart of the emancipation age in each state.

Alabama 19  
Alaska 18 Up to age 19 or the date of graduation whichever comes first. Order required to have Post Majority support language.
Arizona 18 Up to age 19 while the child is attending high school.
Arkansas 18 If the child is attending high school, upon the child’s high school graduation or the end of the school year after the child reaches 19 years of age, whichever is earlier.
California 18 Up to age 19 while the child is attending high school.
Colorado 19 Emancipation is extended by enrollment in high school or an equivalency program, but not beyond age 21.
Connecticut 18 Until the completion of twelfth grade or age 19, whichever comes first.
Delaware 18 Up to age 19 while the child is attending high school.
DC 21  
Florida 18 If the child is still in high school and expected to graduate before age 19, support ends upon graduation.
Georgia 18 Support order entered after 7/1/92 may provide for the extension of child support to age 20, if the child is still in high school.
Guam 18 Exceptions may be made up to age 19.
Hawaii 18 May continue after age 18 per court order if the child is in school full time.
Idaho 18  
Illinois 18 Up to age 19 while the child is attending high school.
Indiana 19  
Iowa 18 Up to age 19 while the child is attending high school.
Kansas 18 If the child is in high school when they reach 18, support will continue until June 30 of the school year during which the child becomes 18.
Kentucky 18 Up to age 19 while the child is attending high school.
Louisiana 19  
Maine 18 Up to age 19 while the child is attending high school.
Maryland 18 Up to age 19 while the child is attending high school.
Massachusetts 21 Up to age 23 if a child is domiciled with a parent and principally dependent on that parent due to the child’s enrollment in an education program, excluding educational costs beyond an undergraduate degree.
Michigan 18 Up to the age of 19 ½ while the child is attending high school.
Minnesota 18 Up to age 20 while the child is attending high school.
Mississippi 21  
Missouri 18 Up to age 21 while the child is attending high school or if they enroll in college or vocational school by October 1 following high school graduation. See the IRG for more information.
Montana 18 18 or upon graduation from high school, whichever is later but no later than 19.
Nebraska 19  
Nevada 18 Up to age 19 while the child is attending high school.
New Hampshire 18 18 or until no longer enrolled in high school, whichever is later.
New Jersey 19 May continue beyond 19 in certain circumstances, not to exceed the child’s 23rd birthday. See New Jersey: Age of Termination of Child Support Law for more information.
New Mexico 18 Unless still in high school, then up to 19 years of age if stated in court order.
New York 21  
North Carolina 18 If the child is still in primary or secondary school when the child reaches age 18, support will continue until the child graduates, or ceases to attend school on a regular basis, fails to make satisfactory academic progress towards graduation or reaches age 20,
North Dakota 18 Up to age 19 while the child is attending high school.
Ohio 18 Up to age 19 while the child is attending high school.
Oklahoma 18 Up to age 20 while the child is attending high school.
Oregon 18  
Pennsylvania 18  
Puerto Rico 21  
Rhode Island 18 Up to age 19 while the child is attending high school.
South Carolina 18  
South Dakota 18 Up to age 19 while the child is attending high school.
Tennessee 18  
Texas 18  
Utah 18 Courts in divorce actions may order support up to age 21.
Vermont 18 Age of 18 or the termination of secondary education whichever is later.
Virgin Islands 18  
Virginia 18 Up to age 19 while the child is attending high school.
Washington 18 Up to age 19 while the child is attending high school.
West Virginia 18 Up to age 20 if enrolled as a full-time student in a secondary educational or vocational program and making substantial progress towards a diploma.
Wisconsin 18 Up to age 19 while the child is attending high school.
Wyoming 18
