Using contempt as an enforcement remedy requires a high level of research and review before legal pleadings are filed and sentencing is pursued. When determining whether contempt is an option, Child Support Services (CSS) staff must examine a wide variety of supporting documentation, including Oklahoma State Information System (OSIS), Oklahoma court websites, and information submitted by the parties, in order to determine whether CSS has sufficient evidence to support the allegation that the obligor willfully failed to pay child support and is currently able to purge the contempt. Additionally, State’s Attorneys must review cases before pleadings are filed and reevaluate as appropriate whether to continue a contempt action.
