This is the description of the process used for enforcement after a deprived action jurisdiction ceases or is deferred to Child Support Services (CSS).There may be several active cases, such as one Family Group Number (FGN) against each parent, remaining open after the deprived action is completed. One case may be an arrears only case against the parent with whom the minor child has been reunified. The second case may be for enforcement of current child support and/or an arrears amount against the other parent.
Arrears Only Case (reunified with at least one Noncustodial Parent (NCP))
Keep arrears-only cases open for enforcement, if:
- The deprived action closes;
- When Child Support Services (CSS) staff receives information regarding parental reunification they confirm the information with the Child Welfare (CW) worker by requesting a copy of the OKDHS Change in Placement Notification form (CWS-8A), which tracks that the placement has occurred. This information can also be accessed by reviewing the eKIDS system under the Placement tab.
- There has been reunification with one or both parents; and
- Arrears accumulated in the deprived action or under another court order entered prior to the deprived action.
Update the Oklahoma Support Information System (OSIS) CHU screen with the child’s information; update the case on OSIS to 06 or 08 status; amend the IWO or eIWO to include only a monthly payment plan amount; and continue to enforce the child support order with any appropriate judicial and non-judicial remedies for the collection of arrears. The order must be docketed prior to enforcement according to the procedures discussed in Docketing Child Support Orders in Child Welfare Cases.
Current Child Support with Possible Arrears (not reunified with NCP)
Enforcement against the parent(s) not reunified with the child should proceed in the same manner as any other CSS enforcement case. The order must be docketed prior to enforcement according to the procedures discussed in Docketing Child Support Orders in Child Welfare Cases.
Update the Oklahoma Support Information System (OSIS) CHU screen with the child’s information and continue to enforce the child support order with any appropriate judicial and non-judicial remedies. The order must be docketed prior to enforcement according to the procedures discussed in Docketing Child Support Orders in Child Welfare Cases.
